Terms of Service

These Terms govern your use of fotosíntesis, the Agentic Ancestry Scan (AAS), and the Heritage Ecosystem. By downloading or using fotosíntesis, you agree to these Terms. Please read them carefully — especially the sections on AAS result accuracy, subscription billing, and acceptable community conduct.

1. Acceptance of Terms

These Terms of Service ("Terms") form a legally binding agreement between you and WareActics Corporation ("Agentic Ancestry," "we," "us," or "our"), the operator of fotosíntesis. By downloading, installing, or using the fotosíntesis iOS application or any related website or service (collectively, the "Service"), you agree to be bound by these Terms.

If you are using fotosíntesis on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

If you do not agree to these Terms, do not use the Service.

2. Description of Service

fotosíntesis is a phenotype-based ancestry intelligence platform for iOS. The core product is the Agentic Ancestry Scan (AAS) — a three-layer analysis system that generates ancestral origin estimates from facial landmark measurements, body proportion analysis, and a phenotype survey.

fotosíntesis also includes the Heritage Ecosystem — a social platform featuring 50 global Heritage Groups, ancestral Families, and a community feed built around shared ancestry.

Ancestry results produced by fotosíntesis are educational estimates based on phenotype science and are not genetic tests. See our Scientific Disclaimer for full details.

3. Account Registration

To use fotosíntesis you must create an account. You agree to:

  • Provide accurate and current information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized account access at support@agenticancestry.com
  • Create and maintain only one personal account
  • Be at least 13 years of age (or the age of digital consent in your jurisdiction, whichever is greater)

You are responsible for all activity that occurs under your account.

4. Subscriptions and Billing

4.1 Service Tiers

  • Free: 3 lifetime Agentic Ancestry Scans (face + body), ancestry mosaic, confidence score, and personal profile. No credit card required.
  • Heritage ($9.99/month or $59.99/year): Unlimited AAS scans, full 40-question AAS Survey, Master Ancestry Score history, Heritage Groups (all 50), Heritage social feed, and Join ancestral Families.
  • Heritage+ ($19.99/month or $99.99/year): Everything in Heritage, plus Create & lead your own ancestral Family, advanced phenotype matching, maternal/paternal signal separation, Voice Scan (when available), and priority access to new AAS scan types.

4.2 Apple In-App Purchase

All paid subscriptions are processed exclusively through the Apple App Store using Apple In-App Purchase (StoreKit 2). WareActics Corporation does not collect, store, or process payment card information. Your billing relationship is with Apple Inc., and Apple's terms and privacy policy govern all payment transactions.

4.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. You can cancel at any time through your Apple ID subscription settings (Settings → [Your Name] → Subscriptions).

4.4 Refunds

Refund requests for Apple In-App Purchases must be submitted to Apple at reportaproblem.apple.com. WareActics Corporation does not issue direct refunds for App Store purchases.

4.5 Price Changes

We reserve the right to change subscription prices. If we increase prices, we will provide at least 30 days' notice, and the new price will take effect on your next renewal date.

5. Acceptable Use

You agree to use fotosíntesis only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Submit photographs of other people without their explicit consent for AAS analysis
  • Attempt to reverse-engineer, decompile, or disassemble the AAS or any part of the Service
  • Use automated tools, bots, or scripts to access or interact with the Service
  • Attempt to gain unauthorized access to any systems or accounts
  • Use the Service for any fraudulent or deceptive purpose
  • Circumvent scan limits by creating multiple accounts
  • Reproduce, distribute, or sell AAS results for commercial purposes without written permission
  • Interfere with the proper working of the Service

6. Heritage Ecosystem Community Standards

The Heritage Ecosystem is built around shared ancestry. To maintain a respectful, educational, and culturally aware community, you agree to:

  • Post only heritage-relevant, respectful content in the social feed
  • Treat all Heritage Groups and their members with dignity and respect
  • Not post content that demeans, stereotypes, or mocks any ethnic, racial, or cultural group
  • Not harass, bully, or threaten other users
  • Not post illegal content, spam, or misinformation
  • Not impersonate other users or public figures
  • Not use the Heritage feed for commercial solicitation

We reserve the right to remove content and suspend or terminate accounts that violate these community standards, without prior notice.

7. Intellectual Property

7.1 Our Property

The fotosíntesis application, the Agentic Ancestry Scan (AAS) system, the Master Ancestry Score (MAS) methodology, the Heritage Ecosystem platform, all underlying technology, source code, algorithms, designs, and brand elements (including the fotosíntesis name, logo, and trade dress) are the exclusive property of WareActics Corporation. All rights reserved.

7.2 Your Content

You own your ancestry data, survey responses, and content you post to the Heritage Ecosystem. By posting content to the Heritage Ecosystem, you grant us a limited, non-exclusive, royalty-free, worldwide license to display, distribute, and make available your content to other users within the platform.

You represent that you have all rights necessary to grant this license, and that your content does not infringe any third-party rights.

7.3 Feedback

If you provide suggestions, ideas, or feedback about fotosíntesis, you grant us a perpetual, irrevocable, royalty-free license to use that feedback in any way without compensation to you.

8. Scientific Disclaimer and Limitation of Results

Important: AAS ancestry results are phenotype-based statistical estimates — not genetic tests. Results are for educational and exploratory purposes only. They should not be used for medical, legal, immigration, employment, insurance, tribal enrollment, or identity documentation purposes.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WAREACTICS CORPORATION DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION:

  • Any implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Any warranty that AAS results will be accurate, complete, or reliable
  • Any warranty that the Service will be uninterrupted, error-free, or free of viruses or other harmful components

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WAREACTICS CORPORATION, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, goodwill, or business opportunities
  • Damages arising from reliance on AAS ancestry results
  • Damages exceeding the amount paid by you to us in the twelve months preceding the claim

These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability) and even if we have been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify, defend, and hold harmless WareActics Corporation and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your Heritage Ecosystem content.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict of laws provisions. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Orange County, California for resolution of any disputes arising from these Terms or the Service.

Before filing any legal claim, you agree to first contact us at support@agenticancestry.com and give us 30 days to resolve the issue informally.

13. Termination

We may suspend or terminate your access to the Service immediately, without prior notice, if you violate these Terms, engage in fraudulent activity, or if we determine termination is necessary to protect other users or the Service.

You may terminate your account at any time from within the app. Termination does not entitle you to a refund of any prepaid subscription fees.

Upon termination, your right to use the Service ceases immediately, and we may delete your account data as described in our Privacy Policy.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide at least 14 days' notice via email or an in-app notification. Your continued use of fotosíntesis after the effective date of revised Terms constitutes your acceptance.
